Gibbs has now been moved to a prison in Vienna two months after his arrest in France.

Rapper Freddie Gibbs was extradited to Austria in late July and is currently in prison in Vienna relating to a 2015 alleged rape charge. The Gary, Indiana native has consistently denied the accusations through his lawyers.

The move to Austria is the latest development following Gibbs’ arrest in early June as he was due to perform in Toulouse, France. Gibbs was arrested on a European warrant issued by Austria claiming he had raped a woman there in 2015.

Gibbs was eventually released on bail from the French jail a couple weeks later. His passport was taken and he was awaiting a hearing on the case. His fiancee joined him to offer moral support. In late June, a French judge granted the extradition request which Gibbs’ lawyers attempted to appeal.

According to Orf.at, the French Supreme Court upheld the extradition and the rapper was moved to Josefstad prison in Vienna last Sunday. He has yet to be formally charged.

In a statement issued following his release on bail from the prison in Toulouse, Scott E. Leemon, lawyer for Gibbs, said “he has worked too hard on his career and family to get where he is and is in complete shock over this false allegation.” The lawyers also stressed that there appeared to be no evidence, scientific or physical, to back up the accusations from Austrian authorities.

Update: FACT has received a letter from Gibbs’ attorney Theodore Simon, via Gibbs’ PR company Liberal Arts. Read below.

“Mr. Freddie Gibbs while free on bail in France voluntarily withdrew his procedural extradition appeal. He did so to work cooperatively with authorities to assure a smooth transfer to Austria and to further enhance the opportunity for an expedited decision on the merits. Freddie has faithfully abided by all terms and conditions of his release and transfer set by the Court.

He continues to pursue every available means to demonstrate that he is absolutely innocent and that he has been both belatedly and wrongly accused. To be clear and accurate, to date Freddie Gibbs has not, we reiterate, Freddie Gibbs has not been charged with any offense. An investigation is continuing. Mr. Gibbs remains hopeful that a thorough and searching investigation will reveal the actual facts, including the absence of any scientific, physical, or credible evidence implicating him, thereby paving the way for his exoneration and return to his family and one-
year old child.

Consistent with the available legal practices and procedures in Austria, Mr. Gibbs will ask the Court to release him on bail, under reasonable terms and conditions, as was done in France.

Through counsel Mr. Freddie Gibbs has consistently remained fully cooperative with law enforcement offices and judicial systems in both France and Austria and will continue to do so.”
